Minister Sprawiedliwości Zbigniew Ziobro, realizując swoje nadzwyczajne uprawnienia nadane art. 17 ust 1 ustawy z dnia 12 lipca 2017r. o zmianie ustawy prawo o ustroju sądów powszechnych, odwołał przed upływem ustawowo określonych kadencji niemal 150 prezesów i wiceprezesów sądów.

W wielu przypadkach decyzje zostały skrytykowane przez organy samorządu sędziowskiego z uwagi na brak ich merytorycznego uzasadnienia lub z uwagi na uzasadnienia zawierające nieprawdziwe informacje:

Najczęściej pojawiające się i najbardziej typowe działania administracji sądowej, które łatwo mogą prowadzić do naruszeń niezawisłości stały się podstawą do sformułowania, na zasadzie antytezy ,,Zbioru dobrych praktyk nadzorczych”. Ostatnie cztery tezy wskazują na najbardziej rażące formy ingerowania w niezawisłość.  Powstały one w wyniku prac Forum Współpracy Sędziów i zostały przesłane do KRS celem rozważenia podjęcia stosownej uchwały w tej materii .

The most frequent and the most typical practices of court management which may easily lead to violation of independence have provided the basis for compiling, by contrast, “A Collection of Good Management Practices” . The last four items represent the most blatant examples of interfering with independence. The collection is a result of the work of the Forum for the Cooperation of Judges. Judges Cooperation Forum and have been sent to the National Council for the Judiciary (NCJ) for consideration whether an appropriate resolution should not be adopted.

Association of Polish Judges "Iustitia" strongly condemns the unprecedented attack on Judge Aileen Donnelly by the few Polish news media. This attack directed against a judge is contrary to the values adopted by Polish society and constitutes a violation of the democratic principle that empowers the mass media to criticize judgments of courts and not particular judges. Association of Polish Judges "Iustitia" expresses solidarity with Judge Aileen Donnelly and all other Irish judges in defense of the democratic values of an independent judiciary.

Stowarzyszenie Sędziów Polskich „Iustitia” stanowczo potępia bezprzykładny atak na Sędzię Aileen Donnelly ze strony nielicznych mediów w Polsce. Atak ten skierowany przeciwko osobie sędziego jest sprzeczny z wartościami przyjętymi przez społeczeństwo polskie i stanowi naruszenie demokratycznej zasady uprawniającej środki masowego przekazu do krytyki orzeczeń sądów a nie sędziów. Stowarzyszenie Sędziów Polskich „Iustitia” wyraża pełną solidarność z sędzią Aileen Donnelly oraz wszystkimi sędziami irlandzkimi w obronie wartości demokratycznych, jakie niesie z sobą niezawisłe sądownictwo.

This response to the White Paper compendium presented by the Government of the Republic of Poland to the European Commission was prepared by the Polish Judges Association “Iustitia”, together with a team of experts, in order to present a realistic picture of the reforms of the Polish justice system, which have been made in Poland over the last two years.

The response is designed in the following manner: the argument contained in the document prepared by the Government of the Republic of Poland (written in italics and presented within inverted commas) is first cited and this is followed by a response to this argument presented by the “Iustitia” Association.  The “Iustitia” Association will present a comprehensive response to the White Paper in a separate document.
